1. Introduction

Welcome to Acts2Track. These Terms of Service ("Terms") govern your use of our care ministry management software and services (the "Service") provided by Acts2Track ("we," "us," or "our").

By creating an account or using Acts2Track, you agree to these Terms. If you're using the Service on behalf of a church or organization, you represent that you have authority to bind that organization to these Terms.

Please also review our Privacy Policy, which explains how we collect and use your data.

2. Service Description

Acts2Track is a care ministry management platform designed for churches. The Service includes:

  • Care recipient management and tracking
  • Visit logging and coordination
  • Team and volunteer management
  • AI-powered pre-visit briefings
  • Financial assistance tracking
  • Analytics and reporting
  • Email notifications and reminders

We continuously improve the Service and may add, modify, or remove features. We'll notify you of significant changes that affect your use of the Service.

3. Account Registration & Responsibilities

Account Creation

To use Acts2Track, you must:

  • Provide accurate and complete information during registration
  • Be at least 18 years old or have authority to enter contracts
  • Use a valid email address that you control

Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring users you invite comply with these Terms

Administrator Responsibilities

Church administrators are responsible for:

  • Managing user access and permissions appropriately
  • Ensuring data entered complies with applicable laws
  • Obtaining any necessary consents for care recipient data
  • Training users on proper use of the Service

4. Subscription & Billing

Free Trial

  • New accounts receive a 30-day free trial
  • No credit card required to start your trial
  • Full access to all features during the trial period
  • Trial converts to paid subscription only if you choose to subscribe

Pricing Plans

  • Monthly: $30 per month
  • Annual: $300 per year (2 months free)
  • Founding Member: $15 per month for life (limited to first 50 churches)

All plans include unlimited users, all features, and AI briefings. No per-user fees.

Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Payment is processed securely through Stripe
  • You authorize us to charge your payment method on file
  • Prices may change with 30 days notice; existing subscribers keep their rate until renewal

Cancellation

Cancel anytime, no penalties.

You can cancel your subscription at any time through your account settings. After cancellation:

  • Your subscription remains active until the end of your billing period
  • You retain full access until that date
  • No partial refunds for unused time on monthly plans
  • Annual plans: Contact us within 30 days of purchase for a prorated refund

Failed Payments

If a payment fails, we'll notify you and retry the charge. After multiple failed attempts, your account may be suspended until payment is resolved. We'll always give you notice and time to update your payment method.

5. Data Ownership & Export

Your Church Owns Your Data. Always.

All data you enter into Acts2Track—including care recipient information, visit records, notes, and financial records—belongs to your church. We do not claim ownership of your data.

License to Provide Service

You grant us a limited license to use your data solely to:

  • Provide and operate the Service
  • Generate AI-powered briefings
  • Send notifications on your behalf
  • Create backups and ensure data integrity
  • Provide technical support

This license ends when you terminate your account.

Data Export

Export your data anytime.

You can export all your data at any time through your account settings. Exports are available in standard formats (CSV, JSON) that can be imported into other systems.

Data After Termination

After your subscription ends:

  • Your data is retained for 30 days in read-only mode
  • During this period, you can export your data or resubscribe
  • After 30 days, your data is permanently deleted
  • We recommend exporting your data before canceling

6. Acceptable Use

You agree to use Acts2Track only for lawful purposes. You may NOT:

  • Use the Service for any illegal activity
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service for other users
  • Use the Service to harass, abuse, or harm others
  • Scrape, copy, or redistribute the Service without permission
  • Violate the privacy or rights of care recipients
  • Resell or sublicense access to the Service

Violation of these terms may result in immediate suspension or termination of your account.

7. Service Availability

We strive to provide reliable, uninterrupted service, but we cannot guarantee 100% uptime.

Our Commitment

  • We target 99.9% uptime for the Service
  • We monitor systems 24/7 and respond promptly to issues
  • We perform regular backups to protect your data

Planned Maintenance

  • Scheduled maintenance typically occurs during low-usage hours
  • We'll notify you in advance of planned downtime when possible
  • Maintenance windows are kept as brief as possible

Service Interruptions

The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any interruption or loss of service.

8. Intellectual Property

Acts2Track and its original content, features, and functionality are owned by Acts2Track and are protected by copyright, trademark, and other intellectual property laws.

The Service is licensed, not sold. You receive a limited, non-exclusive, non-transferable license to use the Service for your church's internal purposes during your subscription.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" without warranties of any kind, express or implied
  • We do not warrant that the Service will be uninterrupted, error-free, or secure
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim

Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Acts2Track and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit to the Service

11. Termination

Termination by You

You may cancel your subscription and terminate your account at any time through your account settings. Cancellation takes effect at the end of your current billing period.

Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • Your payment fails repeatedly
  • We're required to do so by law
  • We discontinue the Service (with at least 90 days notice)

Effect of Termination

  • Your right to use the Service ends immediately (or at billing period end for cancellations)
  • You have 30 days to export your data before it's deleted
  • Provisions that should survive termination (like limitation of liability) remain in effect

12. Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to contact us at support@acts2track.com and attempt to resolve the dispute informally for at least 30 days.

Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Jurisdiction

Any disputes not resolved informally will be resolved in the state or federal courts located in Texas. You consent to the jurisdiction of these courts.

13. Changes to Terms

30-day notice before any material changes.

If we make significant changes to these Terms, we will notify you by email at least 30 days before they take effect. This gives you time to review the changes and cancel if you disagree.

Minor changes (like fixing typos or clarifying language) may be made without notice. The "Last Updated" date at the top of this page indicates when these Terms were last revised.

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
